Description: Based on the recent oral argument session of Counterman v. Colorado (a case around cyberstalking and the first amendment), “true threat” (2023) features footage of Chief Justice John Roberts, in which he argues that the statement, “Staying in cyber life is going to kill you,” cannot be considered as genuinely threatening regardless of its context. Given that the United States Supreme Court doesn’t allow cameras in the courtroom, there is no video footage of Justice Roberts saying these words besides the transcript and audio recording. The use of AI technology attaches a tangible body to the speech while problematizing the first amendment as a tool for oppression and patriarchal violence.
